PROCUREMENT REFERENCE NO: SFFRFM/RFP/CS/2025-26/1

DATE OF ISSUE: 02ND MARCH, 2026

1. The Smallholder Farmers Fertilizer Revolving Fund of Malawi (SFFRFM) budgeted resources, in the Financial Year 2026/27, to implement various programmes. SFFRFM now intends to use part of the funds on payments for Provision of Legal Services on Retainer Basis.

2 The Chairperson, Internal Procurement and Disposal Committee, hereby invites sealed bids from eligible and qualified legal firms for the Provision of Legal Services on a Retainer Basis.

3. The objective of the assignment is to provide legal services to SFFRFM in both contentious and non-contentious matters at the request of SFFRFM.

The following are the expected outputs and deliverables of the assignment

a. recovery of debts referred to the legal firm.

b. expeditious and successful litigation on behalf of SFFRFM,

c. recovery of costs of proceedings in court matters;

d. mitigating financial or reputational loss of SFFRFM in court matters referred to the legal firm

e. provision of sound legal advice to SFFRFM as requested; and

f. undertaking arbitration and other Alternative Dispute Settlement proceedings on behalf of SFFRFM.

4. The legal firm shall have the following qualifications:

a. being registered with Malawi Law Society with not less than five (5) years' experience in similar assignments. The Legal Firm shall be required to present a record indicating similar previous exercises, and

b. display Knowledge of the operations of the agricultural sector in general and SFFRFM in particular.

5. Bidding will be conducted through Request for Proposals procedures, and firm(s) will be selected in accordance with Quality and Cost Based Selection under Malawi Public Procurement and Disposal of Assets Act (2025) and Public Procurement Regulations (2020).

6. Interested bidders may obtain further information and inspect the Bidding Document through the Procurement and Disposal Unit at the address given in paragraph 8(i) below from 08.00 am to 12.00 noon; 13.00 to 16.00 hours local time (Monday to Friday, except national public holidays). Interested bidders can purchase a complete set of bidding documents in English upon payment of a non-refundable fee of K20,000.00 or a bank-certified cheque to SFFRFM (Cash Office).

7. Interested firms are advised to submit their Technical and Financial Proposals in separate sealed envelopes by 16th March, 2026, at 14:00 hours local Malawi time. The Proposals should be deposited in the Tender Box located at the SFFRFM reception on the second floor of the Ulimi House in Blantyre.

8. Proposals will be opened publicly in the presence of the bidders or their representatives, who choose to attend at the address under item 8 (ii) below at 14:00 hours local time on Monday, 16th March, 2026
